Welcome to Hovercam AI. These Terms of Service ("Terms") govern your use of the Hovercam AI educational platform located at ai.hovercam.com ("Service"), operated by Hovercam ("we," "us," or "our"). By accessing or using our Service, you agree to be bound by these Terms.

Critical: Student Information Policy

You must NOT upload, enter, or transmit any student personally identifiable information (PII) through this Service.

When using student names in any feature (quizzes, trivia, grading, etc.), you must use:

  • First name and last initial only (e.g., "Sarah M." or "James T.")
  • Student nicknames (e.g., "Blue Team Leader" or "Student 1")
  • Anonymous identifiers (e.g., "Participant A" or numbers)

Prohibited information includes: Full names, student IDs, dates of birth, addresses, photos, grades tied to identifiable students, or any other personally identifiable information.

1. Acceptance of Terms

By creating an account or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

If you are using the Service on behalf of a school, school district, or other organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

Hovercam AI provides educational tools and resources for K-12 educators, including but not limited to:

  • Interactive whiteboard tools
  • Educational games and activities
  • AI-powered trivia and quiz generation
  • AI-assisted paper grading tools
  • Document camera integration
  • Classroom management features

Experimental Features Notice

Many features on this platform are experimental. AI-generated content may contain errors and should always be reviewed by educators before use with students. We do not guarantee uptime, availability, or accuracy of AI-generated content.

3. User Accounts

3.1 Account Creation

To access certain features, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your password
  • Promptly update any changes to your information
  • Accept responsibility for all activities under your account

3.2 Account Types

We offer different account types (Free, Pro, Administrator) with varying features and capabilities. We reserve the right to modify features available to each account type at any time.

3.3 Account Termination

We may suspend or terminate your account if you violate these Terms, particularly the student information policy. You may also delete your account at any time by contacting us.

4. Acceptable Use Policy

4.1 Permitted Uses

You may use the Service for:

  • Educational purposes in K-12 classroom settings
  • Creating and delivering educational content
  • Professional development and teacher training
  • Personal educational exploration

4.2 Prohibited Uses

You agree NOT to:

  • Upload student personally identifiable information (PII) - This is strictly prohibited
  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to the Service or related systems
  • Interfere with or disrupt the Service
  • Use the Service to transmit malware or harmful code
  • Scrape, data mine, or extract data from the Service
  • Resell or redistribute the Service without authorization
  • Use the Service to harass, abuse, or harm others
  • Impersonate any person or entity
  • Use the Service in violation of any applicable laws or regulations

5. Student Privacy and FERPA Compliance

Your Responsibility

As an educator, you are responsible for ensuring compliance with the Family Educational Rights and Privacy Act (FERPA) and other applicable student privacy laws. By using this Service, you agree to NOT input any student education records or personally identifiable information.

To help you maintain compliance:

  • Use only first names with last initials (e.g., "Emma R.")
  • Use student nicknames or pseudonyms
  • Use generic identifiers (e.g., "Student 1," "Team A")
  • Review all AI-generated content before sharing with students
  • Do not upload documents containing student PII
  • Do not photograph students for use on this platform

6. Intellectual Property

6.1 Our Content

The Service and its original content (excluding user-generated content), features, and functionality are owned by Hovercam and are protected by copyright, trademark, and other intellectual property laws.

6.2 Your Content

You retain ownership of content you create using the Service. By uploading content, you grant us a non-exclusive license to use, store, and display that content as necessary to provide the Service.

6.3 AI-Generated Content

Content generated by AI features (such as quiz questions, grading feedback, etc.) is provided for your use in educational settings. You are responsible for reviewing and verifying the accuracy of AI-generated content before use.

7. AI Features and Limitations

Our AI-powered features are designed to assist educators but have limitations:

  • Accuracy: AI-generated content may contain errors, inaccuracies, or inappropriate material
  • Review Required: Always review AI-generated content before presenting to students
  • Not a Replacement: AI tools are meant to assist, not replace, professional educator judgment
  • Availability: AI features may be unavailable or limited at times

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties regarding accuracy, reliability, or completeness
  • Warranties of uninterrupted or error-free operation
  • Warranties regarding the accuracy of AI-generated content

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOVERCAM SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Any loss of data, profits, or business opportunities
  • Any damages arising from your use of AI-generated content
  • Any damages resulting from unauthorized access to your account
  • Any damages resulting from your violation of student privacy policies

Our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Hovercam, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including privacy rights
  • Any student information you upload in violation of our policies

11. Modifications to Service and Terms

We reserve the right to:

  • Modify or discontinue any part of the Service at any time
  • Update these Terms at any time
  • Change pricing or features of account types

We will notify users of material changes to these Terms. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of California.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hovercam regarding the Service and supersede any prior agreements.
